Постановлением Пленума Верховного Суда Российской Федерации от 27.06.2013 № 22 «О применении судами законодательства при рассмотрении дел об административном надзоре» обобщена практика применения судами указанного Закона. Разъяснен порядок установления, продления и прекращения административного надзора, в том числе досрочно. Определены случаи частичной отмены или дополнения ранее установленных лицу административных ограничений, таких как: запрещение пребывания в определенных местах; запрещение посещения мест проведения массовых и иных мероприятий и участия в указанных мероприятиях; запрещение пребывания вне жилого или иного помещения, являющегося местом жительства либо пребывания поднадзорного лица, в определенное время суток; запрещение выезда за установленные судом пределы территории; обязательная явка от одного до четырех раз в месяц в орган внутренних дел по месту жительства или пребывания для регистрации.

«Федеральным законом от 02.07.2013 № 182-ФЗ внесены изменения в статью 11 Закона «О порядке рассмотрения обращений граждан Российской Федерации».

Определено, что ответ на обращение не дается в случае, если в письменном обращении не указаны фамилия гражданина, направившего обращение, или (ранее – «и») почтовый адрес, по которому должен быть направлен ответ.

Установлено также, что в случае, если в письменном обращении гражданина содержится вопрос, на который ему неоднократно (ранее – «многократно») давались письменные ответы по существу в связи с ранее направляемыми обращениями, и при этом в обращении не приводятся новые доводы или обстоятельства, должностное лицо в праве принять решение о безосновательности очередного обращения и прекращении переписки с гражданином по данному вопросу.

«В соответствии с ч. 2 ст. 20 Жилищного кодекса РФ постановлением Правительства РФ от 11.06.2013 № 493 «О  государственном жилищном надзоре» определен порядок проведения государственного жилищного надзора».

Установлено, что государственный жилищный надзор осуществляется посредством:

организации и проведения проверок выполнения органами государственной власти, органами местного самоуправления, юридическими лицами, индивидуальными предпринимателями и гражданами обязательных требований к использованию и сохранности жилищного фонда независимо от его форм собственности;

принятия предусмотренных законодательством РФ мер по пресечению и (или) устранению выявленных нарушений;

систематического наблюдения за исполнением обязательных требований при осуществлении органами государственной власти, органами местного самоуправления, юридическими лицами, индивидуальными предпринимателями и гражданами своей деятельности.

В целях осуществления государственного жилищного надзора органы государственного жилищного надзора в пределах установленных полномочий организуют и проводят плановые и внеплановые документарные и выездные проверки.

Предметом проверок является соблюдение органами государственной власти, органами местного самоуправления, а также юридическими лицами, индивидуальными предпринимателями и гражданами:

обязательных требований к жилым помещениям, их использованию и содержанию; содержанию общего имущества в многоквартирном доме; порядку перевода жилого помещения в нежилое помещение и нежилого помещения в жилое помещение; порядку переустройства и перепланировки жилых помещений; управлению многоквартирными домами; установлению размера платы за содержание и ремонт жилого помещения; определению размера и внесению платы за коммунальные услуги; других обязательных требований к использованию и сохранности жилищного фонда независимо от его форм собственности, установленных жилищным законодательством и законодательством об энергосбережении и о повышении энергетической эффективности.

Координацию деятельности органов исполнительной власти субъектов РФ, осуществляющих государственный жилищный надзор, осуществляет Министерство регионального развития РФ.

«Федеральным законом от 02.07.2013 № 178-ФЗ внесены изменений в отдельные законодательные акты Российской Федерации в связи с реализацией международных договоров Российской Федерации о реадмиссии».

Организация выезда не будет связана с использованием средств федерального бюджета, а сам выезд состоится по времени раньше срока, в течение которого иностранный гражданин мог бы быть передан иностранному государству в порядке реадмиссии.

Законом определено, что решения о прекращении процедуры реадмиссии осуществляется федеральным органом исполнительной власти в сфере миграции или его территориальным органом на основании решения руководителя указанного федерального органа или его заместителя, устанавливаются правовые последствия принятия такого решения для иностранного гражданина, а также последствие неисполнения им обязанности по выезду из Российской Федерации в форме повторного возбуждения ходатайства о реадмиссии.

Установлен трёхлетний запрет на въезд в РФ для тех иностранных граждан и лиц без гражданства, которые являлись субъектами передачи иностранному государству в порядке реадмиссии, но в отношении которых было вынесено решение о прекращении процедуры реадмиссии.

Данный Федеральный закон (за исключением отдельных положений) вступает в силу с 02.10.2013.
